Terms of Use, Privacy Notice and Limitation of Liability

1. ACCEPTANCE OF THESE TERMS

By downloading, installing, accessing, subscribing to or using Speed Alert, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions.

If you do not agree with any provision of these Terms, you must not use the application.

2. PURPOSE OF THE APPLICATION

Speed Alert is a driver assistance application designed to provide informational guidance regarding:

  • Vehicle speed.

  • Road speed limits.

  • Overspeed notifications and alerts.

  • Driving assistance features.

Speed Alert is provided solely as an informational and support tool.

Speed Alert is not an official traffic control system, navigation system, legal authority, law enforcement tool or professional driving advisory service.

The application does not replace road signs, traffic regulations, local laws, driver judgement or safe driving practices.

3. DRIVER'S SOLE RESPONSIBILITY

The user acknowledges and agrees that safe driving and compliance with all applicable traffic laws remain solely the responsibility of the driver.

The driver is solely responsible for:

  • Maintaining full attention while driving.

  • Observing road signs and road conditions.

  • Complying with traffic laws.

  • Respecting applicable speed limits.

  • Adapting speed to weather, traffic and road conditions.

  • Making safe driving decisions at all times.

Use of Speed Alert does not transfer any responsibility to Speed Alert, its owners, developers, suppliers or affiliates.

4. ABSOLUTE PRIORITY OF REAL-WORLD TRAFFIC SIGNS

Physical traffic signs, temporary signs, road works, detours, electronic signs, police instructions and directions issued by competent authorities shall always take precedence over any information displayed by Speed Alert.

In the event of any discrepancy between Speed Alert and actual road signage, the driver must always follow the real-world traffic signs and applicable laws.

5. DATA SOURCES AND INFORMATION ACCURACY

Speed Alert may obtain information from third-party mapping services, positioning systems, public databases, private databases and external service providers.

Speed Alert does not guarantee:

  • Accuracy.

  • Completeness.

  • Availability.

  • Reliability.

  • Continuity.

  • Timeliness.

  • Error-free operation.

Displayed speed limits may be inaccurate, outdated, incomplete, delayed or different from those actually in force on the road.

The user expressly accepts this limitation.

6. GEOGRAPHICAL COVERAGE

Coverage and accuracy may vary significantly depending on country, region, city or road.

Speed Alert makes no representation that data will be available, accurate or suitable in any particular jurisdiction.

7. SERVICE AVAILABILITY

Operation of Speed Alert depends on factors outside our control, including:

  • GPS signals.

  • Internet connectivity.

  • Mobile networks.

  • Device hardware.

  • Device settings.

  • Operating systems.

  • Battery status.

  • Third-party providers.

Speed Alert does not guarantee uninterrupted, continuous or error-free service.

8. NO WARRANTIES

The application is provided "AS IS" and "AS AVAILABLE".

To the fullest extent permitted by law, Speed Alert disclaims all warranties, express or implied, including warranties regarding:

  • Accuracy.

  • Reliability.

  • Availability.

  • Fitness for a particular purpose.

  • Non-infringement.

  • Error-free operation.

9. NO GUARANTEE OF AVOIDING FINES OR PENALTIES

Speed Alert does not guarantee the avoidance of:

  • Traffic fines.

  • Administrative penalties.

  • Driving licence point deductions.

  • Licence suspension.

  • Licence revocation.

  • Criminal sanctions.

  • Any legal consequences arising from driving conduct.

All driving decisions remain solely the responsibility of the driver.

10. EXCLUSION OF LIABILITY

To the fullest extent permitted by law, Speed Alert, its owners, developers, employees, contractors, suppliers and distributors shall not be liable for:

  • Traffic fines.

  • Administrative penalties.

  • Licence point deductions.

  • Licence suspension or revocation.

  • Accidents.

  • Collisions.

  • Property damage.

  • Personal injury.

  • Death.

  • Financial losses.

  • Loss of income.

  • Loss of business.

  • Loss of profits.

  • Third-party claims.

  • Direct damages.

  • Indirect damages.

  • Incidental damages.

  • Consequential damages.

Including where such damages result from incorrect information, incomplete information, outdated information, GPS errors, device failures, connectivity failures, third-party failures, service interruptions, mapping errors or software errors.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the total liability of Speed Alert arising out of or related to the use of the application shall not exceed the amount paid by the user for the most recent subscription period immediately preceding the event giving rise to the claim.

If the user has not paid for any subscription or service, Speed Alert shall have no monetary liability.

12. FORCE MAJEURE

Speed Alert shall not be liable for failures caused by events beyond its reasonable control, including telecommunications failures, internet outages, GPS outages, power failures, cyberattacks, natural disasters, governmental actions or third-party service interruptions.

13. CHANGES TO DATA PROVIDERS

Speed Alert may change, replace, suspend or discontinue any mapping provider, data source or technical supplier at any time without prior notice.

14. USER OBLIGATIONS

Users must comply with all applicable traffic laws, regulations and local legislation while using the application.

Users must not use Speed Alert for unlawful purposes.

15. MINIMUM AGE REQUIREMENT

The user declares that they are at least sixteen (16) years old or have reached the minimum legal age required to operate a vehicle or use digital services in their jurisdiction.

16. PRIVACY AND PERSONAL DATA

Speed Alert respects user privacy and processes only information necessary for operation of the service.

17. DATA SHARING

Speed Alert does not sell, rent or commercially exploit personal data.

18. DATA RETENTION

Unless future functionality expressly states otherwise, Speed Alert does not store route histories, journeys or user location histories.

19. DATA PROTECTION REGULATIONS

For users located within the European Union, personal data shall be processed in accordance with the GDPR.

For users located in the United Kingdom, personal data shall be processed in accordance with UK GDPR.

For users located in other jurisdictions, Speed Alert will endeavour to comply with applicable privacy laws to the extent required by local legislation.

20. GOOGLE PLAY AND APP STORE

Distribution through Google Play Store and Apple App Store may involve data processing performed directly by Google or Apple under their respective privacy policies.

Speed Alert is not responsible for the privacy practices of such platforms.

21. SUBSCRIPTIONS AND PAYMENTS

Where subscriptions or paid services are offered:

  • Purchases may be processed by Google Play or Apple App Store.

  • Renewals, cancellations and refunds may be governed by their respective policies.

  • Speed Alert does not control payment processing carried out by Google or Apple.

22. INTELLECTUAL PROPERTY

All trademarks, logos, software, graphics, designs, text, content and other materials associated with Speed Alert remain the exclusive property of Speed Alert or its licensors and are protected by applicable intellectual property laws.

23. SUSPENSION OR TERMINATION

Speed Alert reserves the right to suspend, restrict or terminate access to the service where fraud, abuse, unlawful activity or violations of these Terms are detected.

24. MODIFICATIONS

Speed Alert may update these Terms at any time.

The most recent version shall apply upon publication on the website or within the application.

25. GOVERNING LAW

These Terms shall be interpreted in accordance with the laws applicable in the jurisdiction where Speed Alert is established, without prejudice to mandatory consumer protection rights applicable in the user's country of residence.
